These Terms of Service ("Terms") govern your use of the Koori Constructions Pty Ltd (ABN 85 680 349 571) website kooriconstructions.com.au and your engagement of our building and construction services. By accessing this website or engaging our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our website or services.

2. Website Use

Aboriginal artwork: The custom artwork featured on this website was commissioned from a Central Coast Aboriginal artist and is used with permission. It must not be reproduced or used outside this website.

3. Services

3.1 Scope of Services

Koori Constructions provides the following building and construction services:

  • Residential: New builds, renovations, extensions, granny flats, insurance repairs, NDIS home modifications
  • Commercial: Defence, health, education, community facilities, government projects (as sub-contractor or principal contractor)
  • Maintenance: Planned and reactive maintenance for commercial, government, and residential clients

3.2 Quotes and Estimates

Quotes and estimates provided by Koori Constructions are:

  • Valid for 30 days from the date of issue (unless otherwise stated)
  • Based on information provided by the client at the time of enquiry
  • Subject to site inspection, council approval, and availability of materials
  • Exclusive of GST (unless stated otherwise)

Quotes are not binding contracts. A formal written contract must be executed before work commences.

3.3 Contracts

All building work is governed by a written contract, which may be:

  • HIA Renovations, Additions, and Repairs Contract (for residential work under $20,000)
  • HIA NSW Residential Building Contract (for residential work over $20,000)
  • AS 4000 or AS 4902 (for commercial projects)
  • NEC4 or bespoke contract (for government or tier-1 head contractor projects)

Contracts are subject to:

  • Home Building Act 1989 (NSW) — for residential work
  • Australian Consumer Law — for all services
  • Building Code of Australia (BCA) and relevant Australian Standards
  • NSW Fair Trading requirements and licensing conditions

3.4 Payment Terms

Unless otherwise agreed in writing:

  • Residential projects: Progress payments as per the HIA contract schedule (typically 5-7 stages)
  • Commercial projects: Monthly progress claims or as per contract (e.g., 30-day terms)
  • Small works (under $5,000): 50% deposit, balance on completion

Overdue invoices may incur interest at the rate prescribed by the Penalty Interest Rates Act 1983 (NSW).

3.5 Variations

All variations to the scope of work must be approved in writing before work proceeds. Verbal variations are not binding. Variation costs will be based on:

  • Cost-plus pricing (for time-and-materials work)
  • Fixed-price variation (for defined scope changes)
  • Schedule of rates (where applicable)

3.6 Delays and Extensions of Time

Koori Constructions will make reasonable efforts to complete work within agreed timeframes. However, delays may occur due to:

  • Adverse weather conditions
  • Client-instructed variations or design changes
  • Council or certifier delays
  • Material or labour shortages
  • Unforeseen site conditions (e.g., asbestos, structural defects)
  • Force majeure events (e.g., natural disasters, pandemics)

We will notify you promptly of any delays and negotiate a revised completion date.

4. Warranties and Guarantees

4.1 Statutory Warranties

Under the Home Building Act 1989 (NSW), Koori Constructions provides the following statutory warranties for residential building work:

  • Work will be performed in a proper and workmanlike manner
  • Materials will be suitable for the purpose
  • Work will comply with all applicable laws, regulations, and standards
  • Work will be completed with due diligence and within a reasonable time
  • Defects liability period applies as per contract (typically 6-12 months)

4.2 Home Warranty Insurance

For residential projects over $20,000, Koori Constructions holds Home Warranty Insurance as required by NSW law. A certificate of insurance will be provided before work commences.

4.3 Commercial Projects

For commercial work, warranties and defects liability periods are governed by the contract (e.g., AS 4000 or NEC4). Typical defects liability periods are 12-24 months from practical completion.

5. Liability and Indemnity

5.1 Limitation of Liability — Website

The information on this website is provided "as is" without warranties of any kind, express or implied. While we make reasonable efforts to ensure accuracy, we do not guarantee that:

We are not liable for:

  • Defects caused by client-supplied materials or designs
  • Damage caused by third parties or events beyond our control
  • Consequential loss (e.g., lost profits, alternative accommodation costs) unless expressly agreed in writing

5.3 Indemnity

You agree to indemnify Koori Constructions against any claims, losses, or damages arising from:

  • Your breach of these Terms
  • Your misuse of the website
  • False or misleading information you provide

6. Insurance

Koori Constructions maintains the following insurance:

  • Public Liability Insurance: $20 million (as required for NSW government and tier-1 projects)
  • Workers Compensation Insurance: As required by NSW law
  • Home Warranty Insurance: For residential projects over $20,000 (as required by Home Building Act 1989)
  • Professional Indemnity Insurance: As applicable for design and consulting services

Certificates of currency are available on request.

7. Dispute Resolution

7.1 Informal Resolution

If you have a dispute or complaint, please contact us first at brad@kooriconstructions.com.au or 0448 368 354. We will make reasonable efforts to resolve the issue within 14 days.

7.2 Formal Dispute Resolution

If informal resolution fails, disputes will be resolved as follows:

  • Residential projects: NSW Fair Trading or NSW Civil and Administrative Tribunal (NCAT) — www.fairtrading.nsw.gov.au
  • Commercial projects: Mediation or arbitration as per the contract (e.g., AS 4000 dispute resolution clause)

7.3 Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of NSW.

8. Termination

8.1 Termination by You

You may terminate a contract with Koori Constructions in accordance with the contract terms (e.g., cooling-off period for residential contracts, termination for convenience clauses in commercial contracts).

8.2 Termination by Koori Constructions

We may terminate a contract if:

  • You fail to make progress payments as required
  • You breach the contract (e.g., denying site access, instructing unsafe work)
  • The project becomes impossible or illegal to complete

Termination fees and final payments will be calculated in accordance with the contract.

9. Privacy

Your personal information is collected, used, and protected in accordance with our Privacy Policy. By using this website or engaging our services, you consent to our privacy practices as described in that policy.

10. Third-Party Links

This website may contain links to third-party websites (e.g., suppliers, industry associations, government portals). We are not responsible for the content, accuracy, or privacy practices of external sites. Use of third-party sites is at your own risk.
